Terms of Service

1. Acceptance of Terms
By creating an account, downloading the app, or using MessageFuture (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms form a legally binding agreement between you and Nukylabs LLC (“we”, “us”, “our”).
These Terms apply to the MessageFuture web application, mobile applications (Android and iOS), and all related services.
2. Eligibility
You must be at least 16 years old to use the Service. By creating an account, you confirm that you are at least 16 years of age. We do not knowingly allow persons under 16 to register. If we discover that a user is under 16, we will terminate their account and delete their data.
3. Your account
- You are responsible for maintaining the confidentiality of your password and account credentials.
- You are responsible for all activity that occurs under your account, whether or not you authorised it.
- You must provide accurate and complete information when creating your account and keep it up to date.
- You may not share your account with others, create multiple accounts, or create accounts for the purpose of abuse.
- You must notify us immediately if you suspect unauthorised access to your account.
- You can delete your account at any time from Settings. Account deletion enters a 30-day grace period, after which all data is permanently deleted.
4. Credits, payments, and subscriptions
4.1 Credit system
- The Service operates on a credit system. Credits are required to send messages and use certain features.
- Different message types (text, audio, video, image) have different credit costs. Costs are displayed before you confirm.
- Credits are deducted when you finalize (confirm) a message, not when you save a draft.
- If you edit a previously finalized message, you will only be charged for the difference in cost (if any). No refund is given if the new cost is lower.
4.2 Web purchases (Stripe)
- On the web, credit packs and subscriptions are purchased through Stripe.
- All prices are displayed in your local currency before purchase.
- Subscriptions renew automatically at the end of each billing cycle (monthly or yearly) unless cancelled.
- You can cancel your subscription at any time from Settings or your Stripe customer portal. Cancellation takes effect at the end of the current billing period.
4.3 Mobile purchases (Google Play and Apple App Store)
- On Android, purchases are processed through Google Play Billing. On iOS, purchases are processed through Apple StoreKit (In-App Purchases).
- All mobile purchases are subject to the terms and conditions of the respective app store (Google Play or Apple App Store).
- Subscriptions purchased through app stores renew automatically unless cancelled at least 24 hours before the end of the current billing period.
- To cancel a mobile subscription, use the subscription management in your device settings (Google Play Store → Subscriptions or Apple Settings → Subscriptions). Cancelling within the MessageFuture app alone does not cancel app store subscriptions.
- Refund requests for mobile purchases must be directed to Google Play or Apple, as applicable, per their refund policies.
- We are not responsible for any charges incurred through app store billing errors.
4.4 Refund policy
- Credits are non-refundable once purchased, except as required by applicable law.
- Unused credits do not roll over between subscription periods and expire if your account is closed.
- If your account is deleted, all remaining credits are forfeited.
- We reserve the right to change credit prices or subscription rates with 30 days’ written notice.
4.5 Refunds for blocked deliveries
If a previously scheduled or timeless message cannot be delivered to a recipient because that recipient has blocked the sender (or the sender has blocked the recipient), that specific delivery is cancelled and MessageFuture refunds 50% of the per-recipient share of credits back to the sender’s wallet. The per-recipient share is calculated as the total credits spent on the message divided by the total number of recipients. Recipients who have not blocked the sender will still receive the message as scheduled. If every recipient has blocked the sender, the message is permanently discarded, 50% of the total credits are refunded, and free-tier users have their timeless message lifetime quota slot restored. The remaining 50% is retained as a storage and operational fee covering the encrypted storage and infrastructure already provided. Full details are published in our Community Guidelines.
5. Messages and content
5.1 Your content
You retain full ownership of all messages, media, and content you create on MessageFuture. By uploading content, you grant us a limited, non-exclusive licence to store, encrypt, process, and deliver that content solely as necessary to provide the Service. We will never use your message content for advertising, analytics, or AI model training.
5.2 Message delivery
- Scheduled messages are delivered automatically on the date you set, via email to your specified recipients.
- Timeless messages are stored securely until you or an assigned guardian sets a delivery date.
- We make reasonable efforts to deliver messages on time, but we do not guarantee exact delivery timing. Delivery depends on email infrastructure, recipient availability, and system load.
- If you delete your account, all pending scheduled and timeless messages will be cancelled after the 30-day grace period.
5.3 Media storage
Audio, video, and image files are stored encrypted in the EU. Media files are retained for as long as the associated message exists. When a message is deleted, its media files are also deleted.
6. Guardians
- You may assign one or more trusted guardians to manage your timeless messages.
- Guardians can only perform actions within the permissions you explicitly grant (set delivery date, add recipients, view content).
- You can change or revoke guardian permissions at any time. Revocation takes effect immediately.
- Guardians are notified by email when they are assigned to a message. They must accept the guardian role before they can take any action.
- You are responsible for selecting trustworthy guardians. We are not liable for any actions taken by guardians within their granted permissions.
- A guardian’s access to your messages does not constitute a transfer of ownership. You remain the owner of all content.
7. AI Twin feature
- The AI Twin feature allows you to create a digital representation of yourself that others can chat with.
- AI Twin responses are generated by a third-party AI service based on the personality description and training data you provide. Responses are AI-generated and may not accurately reflect the views of any real person.
- You are responsible for the personality descriptions and content you use to create your Twin. Do not create Twins that impersonate real people without their explicit consent.
- You control who can access your AI Twin through the sharing and access grant system.
- AI Twin conversations are encrypted at rest. Conversation content is sent securely to our AI provider for response generation. The AI provider does not use your data for model training.
- We do not guarantee the accuracy, appropriateness, or quality of AI-generated responses.
- AI Twin chat uses credits. Costs are displayed before each interaction.
8. Acceptable use
You agree not to use the Service to:
- Send unsolicited, harassing, threatening, defamatory, or illegal messages.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload content that infringes third-party intellectual property rights.
- Upload malicious content, viruses, or harmful files.
- Attempt to reverse-engineer, decompile, scrape, or abuse the platform’s APIs or infrastructure.
- Create AI Twins that impersonate real people without their consent.
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Circumvent or attempt to circumvent any security measures or access controls.
Our full list of prohibited content (including zero-tolerance items such as harassment, hate speech, sexual content involving minors, non-consensual imagery, and content promoting self-harm) is published in our Community Guidelines, which form part of these Terms. Users can report content or block other users at any time from within the app; we review all reports within 24 hours.
We reserve the right to suspend or terminate accounts that violate these Terms, without refund of any credits or subscription fees.
9. Intellectual property
The MessageFuture platform, including its design, code, branding, and features, is owned by Nukylabs LLC. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission. Your use of the Service does not grant you any ownership rights in the platform.
10. Service availability and disclaimers
- We aim for high availability but do not guarantee uninterrupted or error-free service.
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not warrant that messages will be delivered at the exact scheduled time, that AI Twin responses will be accurate, or that the Service will meet your specific requirements.
- Scheduled maintenance, cloud provider outages, or other events beyond our control may cause temporary service interruptions.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- Nukylabs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- Our total aggregate liability for any claim related to the Service shall not exceed the total amount you have paid us in the 12 months immediately preceding the event giving rise to the claim.
- We are not liable for the actions of guardians, the content of AI Twin responses, the failure of email delivery by third-party providers, or data loss caused by circumstances beyond our reasonable control.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nukylabs LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
- You may terminate your account at any time by requesting deletion in Settings.
- We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law.
- Upon termination, your right to use the Service ceases immediately. After the 30-day grace period, all your data will be permanently deleted.
- Sections that by their nature should survive termination (including liability limitations, indemnification, and governing law) will survive.
14. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms from time to time. We will notify you by email and in-app notification of material changes at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and delete your account.
